Terms of Service

These Terms of Service ("Terms") govern your use of MyVentaPos, a point-of-sale, online storefront, and escrow payment platform operated by MetroCable SL Limited ("MyVentaPos," "we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use MyVentaPos. If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@myventapos.com if you suspect unauthorized access to your account.

3. The Service

MyVentaPos provides tools to help you run your business, including:

• A point-of-sale system for in-person sales
• An online storefront customers can browse and order from
• Escrow protection for online transactions, where payment is held until delivery is confirmed

Payments are processed through Monime, our licensed payment services provider. MyVentaPos is not a bank; funds held in escrow or in your MyVentaPos balance are processed through licensed payment partners in accordance with applicable regulation.

4. Escrow Terms

When a buyer pays through MyVentaPos escrow:

• Funds are held securely until the buyer confirms receipt of goods, or until an applicable automatic release period elapses
• Sellers are expected to fulfil orders accurately and in good faith
• Either party may raise a dispute through the Service if something goes wrong; we will make reasonable efforts to review disputes fairly, but MyVentaPos is not a court or arbitrator and cannot guarantee a particular outcome
• MyVentaPos reserves the right to hold, delay, or reverse a transaction where fraud or a violation of these Terms is reasonably suspected

5. Fees

MyVentaPos may charge transaction or subscription fees for use of the Service, as disclosed to you within the app at the time of the relevant transaction or plan selection. We will provide reasonable notice of any fee changes.

6. Acceptable Use

You agree not to:

• Use MyVentaPos for any illegal purpose, including fraud, money laundering, or the sale of prohibited goods
• Misrepresent your identity, your business, or the goods/services you sell
• Attempt to circumvent, disable, or interfere with the security or proper functioning of the Service
• Use the Service to harass, defraud, or harm another user

We may suspend or terminate accounts that violate these Terms, or that we reasonably believe pose a risk to the Service, other users, or applicable law.

7. Seller Responsibilities

If you use MyVentaPos to sell goods or services, you are responsible for:

• The accuracy of your product listings and pricing
• Fulfilling orders as described
• Complying with applicable consumer protection, tax, and business licensing laws
• Your own customers' data, collected and used in accordance with applicable data protection law

8. Intellectual Property

MyVentaPos and its logo, design, and software are owned by MetroCable SL Limited. You may not copy, modify, or reverse-engineer the Service except as permitted by law. You retain ownership of the content you upload (e.g. product photos, descriptions).

9. Disclaimers

MyVentaPos is provided "as is." We do not guarantee the Service will be uninterrupted, error-free, or available at all times. We are not responsible for the quality, safety, or legality of goods sold by sellers using the platform.

10. Limitation of Liability

To the extent permitted by applicable law, MyVentaPos and its affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using MyVentaPos at any time. We may suspend or terminate your access if you violate these Terms, or if required by law or regulatory direction.

12. Governing Law

These Terms are governed by the laws of the Republic of Sierra Leone, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice within the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
